New law addresses child support wage assignments AB1426

Employers are required to report bothnew hires and rehired employees to theEmployment Development Department(EDD) within 20 days of the start-of-work date. (For details, visit our Website at www.edd.ca.gov/txner.htm, orcall 916-657-0529.) This informationis cross-matched by federal, state, andlocal agencies against a list of parentswho are delinquent in their childsupport obligations. If a match is found,a child support wage assignment isissued to the employer.

Under a new state law (AB 1426,Wright, effective January 1, 2002),when an employer fails to comply with a wage assignment order, local childsupport agencies and/or supportobligees may obtain a court order torequire the employer to make childsupport paymentsthrough electronicfunds transfer.

Specifically, this law allows a courtorder to be obtained if:(1) an employer willfully fails tocomply with a wage assignment order,or (2) has failed to comply with aparticular wage assignment order onthree separate occasions within a12-month period. It also allows the courts to impose additional penaltiesif an employer fails to comply with acourt-ordered child support wageassignment. An employer found incontempt may face a civil penalty ofup to 50 percent of the support amountnot forwarded to the child supportobligee, including any interest incurredas a result of the employers failure toforward child support payments.
