Pictures show Dennis and Dorina Choban, part of a family who moved from the Ukraine to Citrus Heights and who homeschool their children, protesting a California State Appeals Court ruling on February 28, 2008 that says, according to Judge H. Walter Croskey, "parents do not have a constitutional right to home-school their children." His three-judge panel overturned a trial court's refusal to order children into a "traditional school setting", that is, a public or private school. Judge Croskey's decision is that home schooling parents who don't use "credentialed tutors" can be criminally prosecuted.

The ruling came in the case of Phillip and Mary Long, of Los Angeles. Repeated reports to "Los Angeles County Department of Children and Family Services" for suspicions of child abuse caused a lawyer appointed by the state to "represent" the children and thwart the choice of the parents, demanded that the court order the children into public or private school so that other adults could "monitor the children's safety." A trial court refused to order this. But a three-judge appeals court was found that would overturn the trial ruling.

This is part of a long slide eroding the rights of parents to guard their children from the encroachment of liberal teachers and the liberal teaching establishment. California teachers and administrators regularly refer to homeschoolers with scorn. As expected, several educators welcomed the emphasis on teaching credentials which teachers receive after years of indoctrination in liberal teaching philosophies.

The Chobans thought that there would be less control of education in the United States than in the Ukraine.

  • Brad Dacus, Pacific Justice Institute - "It's shocking. This is without question the greatest sffront to the rights of parents witnessed so far in the state of California." The Pacific Justice Institute law firm has agreed to appeal the ruling to the California Supreme Court. Many families would "without a doubt leave the state, if that means maintaining their freedom."
  • Jack O'Connell, Superintendent of Public Instruction, said he supports parent choice if it supports high quality standards. He issued no direct statement.

  • Pia L. Wong "(The ruling) has the potential to really radically affect people's options in terms of what they want to do with their own children. My jaw dropped when I heard the news."
    • "You don't get (a teaching credential) just because you have children."
    • According to Lookup California State Workers Pay, her title is, ADMINISTRATOR III RANGE A, she works for Sacramento State, and her base pay is $110,004.00
  • Viktor Choban, 24, of Citrus Heights - "(Parents) are the most qualified (to teach children) because you know them best. You raised them up. How can they say you need a credential if your best credentials are God-given credentials and years spent with the children?"
  • Valeriy Choban, "I thought we'd have more freedom here to teach God's truth."
  • Leslie Buchanan, 36 yr. old mother of four in Alta, Placer County, president of [HomeSchool]Create? Association of California, "I know that with legal issues, things take time. There's no certainty right now that this ruling is going to stick."
  • Harold Levine, dean of the School of Education at Univ. of California, Davis, jumped on the bandwagon of educators dismissing home school parents in favor of "credentialed" teachers, claiming that very few parents have the skills and expertise of a credentialed teacher: "Does that make them good or bad teachers? It probably varies."
    • "(It) is such a deeply felt, passionate movement by parents that I think as a society we don't want to ignore that and its potential. At the same time, we don't want to devalue the work that teachers do at our schools that are fully credentialed."
    • HAROLD G. LEVINE is a DEAN (SCHOOL/COLLEGE)-EXEC, at UC DAVIS, with a base pay of $177,999.99

Dacus estimates 166,000 home schooled children, Education Department estimates 50,000 to 100,000.

Requirements for home school in California:

  • File an affidavit to establish home as a private school
  • register children in recognized independent study program
  • Hire a credentialed tutor
